Proposal summary
In 2024, the Federal Constitutional Court ruled that the rules governing biological fathers’ right to challenge legal paternity are unconstitutional and must be revised. This motion calls for a more far-reaching reform of parentage law than the Federal Government has planned so far. Specifically, the child’s best interests are to be placed more firmly at the center, sperm donors are to be explicitly excluded from the right to challenge, and prior violence against the mother or the child is to be set out as a clear ground for exclusion. In addition, the option to repeat challenge proceedings is to be significantly restricted.
