Proposal summary

A bill proposes replacing Article 143h of the Basic Law. Until now, this article classifies climate protection measures as being of overriding public interest and thus provides the constitutional basis for energy transition policy. In future, instead, a reliable, affordable, and weather-independent energy supply would be given that status. Measures to reduce CO2 and expand renewable energy would be explicitly classified as not being in the overriding public interest. This would create the legal basis to repeal corresponding laws such as the Renewable Energy Sources Act.
